The reason provided for this preference is that Options 2(a) and 2(b) would provide greater commercial flexibility over the long-term – with Option 2(b) providing the greater flexibility of the 2 options.
However, where a converted casino premises seeks to utilise the extended gaming machines entitlement, it will need to vary its premises licence to show the table gaming area on the plan, whether or not there are changes to any other part of the premises used for gambling or the non-gambling area. In addition, Small 2005 Act casinos which take advantage of the new machine to table ratio, and/or the reduced minimum table gaming area, will also need to apply to their local licensing authority to vary their premises licence, given the changes in non-gambling and gambling areas. The changes made enable the holder of a converted casino premises licence relating to premises in England and Wales to make up to 80 gaming machines (including Category B gaming machines) available for use, provided a number of specified conditions are satisfied (“the extended entitlement”). Regulation 3 of these Regulations amends section 172(5)(b)(i) of the Gambling Act 2005 (c. 19) (“the Act”) to change how to calculate the number of gaming machines that may be made available for use in small casinos licensed under the Act. Its remit covers arcades, betting, bingo, casinos, slot machines and lotteries, as well as remote gambling, but not spread betting which is regulated by the Financial Conduct Authority.
On that basis, licensing authorities can request access to local risk assessments when no application to vary the premises licence has been made. Section 187(1)(a) is not applicable in this case because Regulations entitle them to offer betting on their casino premises. They have the appropriate OL requirements in place and will be providing betting facilities on their converted casino premises. The licensee can do this by making an application to vary their premises licence to the relevant licensing authority. Where an application to vary a premises licence is required, the licensing authority’s Statement of Principles may include more detailed guidance on what should be covered in the application. An application to vary a premises licence will be required where the licence holder wishes to take advantage of the new entitlements under the Regulations but there is already a condition attached to the premises licence by the licensing authority which prohibits the proposed change.
On the basis that the demand from these machines comes largely from adults, we expect a limited impact on GGY from these machines as a result of this measure, especially with machines remaining where they can be played by adults who are accompanied by children. Granular data is not available on how many of these are ‘cash-out’ slot-style machines, which are in scope of this measure. Any more restrictive changes could potentially exacerbate the impact on places like seaside arcade economies by making these machines inaccessible to adults accompanied by children. Making it an offence for a person to invite, cause or permit a child or young person to use these machines should act as a further incentive to abide by the rules. The current industry voluntary code allows these machines to remain alongside all other types of Category D machines. Moving them to an age restricted area would disproportionately impact small businesses who are reliant on streams of income from all of their different types of machines.
The Advertising Standards Authority (ASA) regulates gambling advertising, though LCCP breaches by licence holders are enforced by the Commission itself. The most recent significant RTS update came into effect on 17 January 2025, extending requirements previously applicable only to slots to a wider range of online casino products. The RTS set out the technical requirements for remote gambling systems and gambling software.
Therefore, under Option 1, we believe there is significant potential for operators to offer predominantly Category B cabinets while meeting their Category C and D ratio through in-fills and tablets. This is a necessary objective to help mitigate against gambling-related harm. We are particularly concerned that Option 1 may encourage new operators to enter the market with the specific intention of maximising their Category B cabinet offer in this way. Therefore, some respondents argued that Option 3 would be the most sensible long-term approach for securing safer gambling functionality and messaging across these venues. However, overall almost half of respondents from the arcade and bingo sector acknowledged that Option 3 posed a risk of increasing gambling-related harm. There was a general consensus across respondents that Option 3 presented the greatest risk of increasing rates of gambling-related harm.
Compliance and Enforcement Measures
We propose that the default limits for B1 machines are aligned to those machines in arcades, bingo halls and betting premises. Under the current rules, there is a risk that operators entering the market might use in-fills and tablets to account for the totality of their Category C and D offer while offering Category B machines exclusively on more popular cabinet machines. We also received a small number of responses from gaming machine manufacturers and suppliers to the supplementary consultation. Given the small number of responses, we assume that the favoured option amongst licensing authorities remains Option 2. We also received a small number of responses from local authorities, charities and gaming machine manufacturers.
